In the intricate world of construction projects, subcontracting plays a crucial role in achieving success. However, navigating the complexities of subcontracts requires a keen understanding of both the opportunities they present and the risks they entail. Today, subcontracts are increasingly complex and burdensome, with general contractors transferring more risk, responsibility, and liability onto subcontractors. Therefore, it is imperative for subcontractors to gain a deeper understanding of contracts before potential problems arise, rather than after.

In this workshop, we will delve into the strategies and practices that enable participants to leverage subcontracting opportunities to their fullest potential while mitigating associated risks. Whether you're a seasoned subcontractor or new to the subcontracting arena, this workshop is designed to provide valuable insights and practical tools to enhance your subcontracting endeavors. 

Participants will utilize a manual featuring spreadsheets and checklists to explore the contractual responsibilities of subcontractors. We will examine clauses pertaining to design responsibility, performance specifications, conduit or flow-down provisions, scope of subcontract work, payment terms, insurance requirements, protection of work, warranties, and temporary site facilities. Furthermore, we will delve into contract law, terms and conditions, incorporation by reference, and other pertinent contract terms.

Participants will collaborate to develop a "Subcontract Handbook," enhancing your understanding of contract requirements. Additionally, we will utilize a green, amber, and red-light system to analyze actual subcontract clauses, empowering participants to identify clauses of concern when reviewing and comprehending construction contracts they are considering bidding on or signing.

This workshop offers a unique resource: a comprehensive manual serving as a reference and companion throughout the sessions. Drawing upon over 40 years of collective experience in the construction industry, this manual is a valuable asset. It provides practical how-to guides, checklists, and templates, serving as a foundation for implementing new processes and procedures, whether in the office or on the jobsite.

Who should attend?

Subcontractors, project managers, construction managers, general contractors, estimators, contract administrators and allied professionals in the construction industry. 

Course Format:

  • Virtual instructor-led training (live and online), with a maximum class size of 16 students. 
  • Facilitated by the instructor on the AdobeConnect platform. Access information from the instructor will be provided to you in advance of the training.

Course Requirements (Technology & Participation):

This course requires full face-to-face interaction and participation from both the instructor and students. In order to attend, you’ll must make sure you have the following:

  • Computer or laptop with webcam (webcams are mandatory): This course will involve 100% on-screen interaction with your instructor and classmates, reading/viewing on-screen content like slides or videos, and interacting via typing with questions or responses. For this reason, you must have a webcam and use a full computer/laptop, and we do not permit students to attend using a tablet or cell phone.
  • A quiet space with minimal distractions: Please plan to be fully engaged in the class, and clear your work schedule just as you would for attendance in an in-class program.

Attendance in both sessions is mandatory for course completion.

Course Instructor Information

Lee Kelly, M.A.A.T.O., P.GSC.

 

Lee's career began on the drafting boards on an Architect's office. There she learned a lot about the design perspective of construction but when she realized that Contractors had more fun, she left the boards and put on steel toed boots. With over 30 years of construction management experience under her belt, Lee has gained extensive knowledge and a solid foundation in construction practices, processes, and procedures. Lee was recently awarded The Construction Institute of Canada (TCIC) Chancellor's Award of Excellence.
